What is Probate?

Probate is a general term used when administering the Estate of a deceased.

Applying for a Grant of Probate is the official proving of a Will through the Probate Registry which is part of the Family Court. The Probate Registry require the original Will to be filed on application for Probate and the Will becomes a public record. The Probate Registry check the Will to ensure that it has not been tampered with and is signed and witnessed correctly, if the Will is in order the Probate Registry will then issue a sealed Grant of Probate.
